Terms of Service
These terms govern your use of SwiftHaul's platform and logistics services. By using our services you agree to be bound by them.

1. Acceptance of Terms
By accessing or using the SwiftHaul website, tracking portal, or logistics services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
SwiftHaul Logistics ("SwiftHaul", "we", "us") reserves the right to modify these Terms at any time. We will notify you of material changes. Continued use of the Services after changes take effect constitutes acceptance.
2. Description of Services
SwiftHaul provides:
- Air freight forwarding and express courier services
- Ocean freight forwarding (FCL, LCL, and RoRo)
- Road and express ground transportation (FTL and LTL)
- Warehousing, cross-docking, and pick-and-pack fulfilment
- Last-mile delivery to residential and commercial addresses
- Customs brokerage and trade compliance advisory
- A shipment tracking and visibility platform
Specific service terms, SLAs, and rates are governed by the commercial agreement or service order between SwiftHaul and the customer. In case of conflict, the commercial agreement prevails over these general Terms.
3. User Accounts and Responsibilities
To access the dashboard or API, you must create an account. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access at Contact@swifthaul.com
- Ensuring all information you provide is accurate and kept current
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to our platform.
4. Prohibited Uses
You agree not to use the Services to:
- Ship prohibited, restricted, or sanctioned goods (see Section 5)
- Violate any applicable local, national, or international law or regulation
- Provide false or misleading shipment declarations to carriers or customs authorities
- Reverse-engineer, scrape, or attempt to gain unauthorized access to our systems
- Transmit viruses, malware, or any code of a destructive nature
- Resell or sublicense access to the platform without written authorization
5. Prohibited and Restricted Commodities
SwiftHaul does not accept for transport:
- Illegal goods, narcotics, or controlled substances
- Weapons, firearms, ammunition, and explosives (without appropriate licensing and prior written approval)
- Goods subject to international sanctions or export controls without required licenses
- Counterfeit, pirated, or trademark-infringing goods
- Hazardous materials not declared and packaged per IATA/IMDG regulations
- Human remains, live animals, or perishables without prior approval and appropriate packaging
SwiftHaul reserves the right to inspect, refuse, or return shipments suspected of containing prohibited goods. You will bear all costs and liabilities arising from non-compliant shipments.
6. Rates, Payment, and Invoicing
Rates are as agreed in the applicable service order or rate card. SwiftHaul may apply fuel surcharges, security surcharges, and remote area delivery fees as disclosed at the time of booking.
- Invoices are due within 30 days of issuance unless otherwise agreed in writing
- Late payments accrue interest at 1.5% per month (or the maximum lawful rate, whichever is lower)
- Disputed invoices must be raised in writing within 14 days of receipt with supporting documentation
- SwiftHaul reserves the right to suspend services for accounts more than 45 days overdue
7. Liability and Claims
SwiftHaul's liability for loss, damage, or delay is limited to the lesser of: (a) the declared value of the shipment, (b) the actual proven loss, or (c) the applicable carrier's standard tariff limit (typically USD 100 per shipment unless excess value is declared and insured).
SwiftHaul is not liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profit, revenue, or business opportunity
- Delays caused by customs clearance, weather, strikes, or force majeure events
- Damage arising from inadequate packaging by the shipper
Cargo claims must be filed in writing within 7 days of delivery for visible damage, or 14 days for concealed damage, or 30 days for total loss. Claims filed outside these windows will not be accepted.
8. Insurance
SwiftHaul's standard liability is not a substitute for cargo insurance. We strongly recommend shippers obtain appropriate all-risk cargo insurance. SwiftHaul can arrange cargo insurance on request — contact your account manager for details.
9. Intellectual Property
All content, software, trademarks, and technology on the SwiftHaul platform are owned by SwiftHaul or its licensors and are protected by applicable intellectual property laws. You may not copy, distribute, or create derivative works without prior written consent.
You grant SwiftHaul a limited licence to use shipment data you provide solely to perform the Services and, in aggregated and anonymised form, to improve our platform.
10. Termination
Either party may terminate a service agreement on 30 days' written notice unless a different notice period is specified in the commercial agreement. SwiftHaul may terminate immediately upon material breach, insolvency, or violation of prohibited use provisions.
Upon termination, you must pay all outstanding invoices. Provisions of these Terms that by their nature should survive termination (including liability, indemnity, and dispute resolution) will do so.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising from these Terms will be resolved by binding arbitration administered by the American Arbitration Association in Houston, Texas, except that either party may seek injunctive relief in any court of competent jurisdiction.
